Litigation is always a last resort. It’s time-consuming, stressful, and very expensive. Few clients (or attorneys) consider it to be pleasant. There are times, however, when litigation is simply unavoidable. Unlike other attorneys, including those at larger, more expensive law firms who have never been inside a courtroom, we have spent a great deal of time engaged in various forms of litigation for our clients when necessary. While negotiating and drafting contracts is an important part of any attorney’s job, it is equally important to have a lawyer with litigation experience who is not hesitant to diligently defend your rights in the courtroom.

Why is it Important to Have an Attorney Who is Familiar with Litigation?

Many times lawyers who focus primarily on contracts or specific transactions lack vital litigation experience. This experience has several important advantages for clients:

  • First, lawyers who are familiar with litigation are in a much better position to develop contracts and other documents that may reduce this risk down the road. Familiarity with problematic contract provisions that can lead to lawsuits allows an attorney to draft language that may either avoid litigation or decrease its duration.
  • Second, if the other party’s attorney has substantial litigation experience and your attorney doesn’t, your company may be at a serious disadvantage during a negotiation. The opposing attorney may be far less agreeable to resolving points in your company’s favor if he/she knows that your lawyer lacks the experience to go to court when necessary.
  • Third, if your company has to go to court, switching to another attorney who specializes in litigation will increase your legal costs in the long run. The new attorney will have to spend a great deal of time learning about your company, its business models, practices, contracts, and the background of the dispute. This extra time means increased legal fees and aggravation in the long term.
